What happens in the event of the paying party commencing Court proceedings for a "true value" determination before the payee commences their "smash and grab" adjudication and the decision of the adjudicator in the "smash and grab" adjudication arrives (obviously) before the Judge's true value determination? Does the paying party have an immediate payment obligation despite their proceedings commencing first and still ongoing?
